(1) These General Terms and Conditions apply to the use of the WoSuch platform — the website at wosuch.com and the mobile apps for iOS and Android.

(3) These Terms apply exclusively to users who use the platform to search for property. For commercial providers — estate agents and property developers — the General Terms and Conditions for Partners (Partner Terms) apply, which are available on wosuch.com.
(4) The version published at the time of use applies. Deviating terms of the user do not become part of the contract unless they have been expressly accepted.
(1) WoSuch is an information platform. It displays property listings that commercial providers publish on their own responsibility and makes it possible to search them.
(2) WoSuch is a hosting service provider within the meaning of § 16 of the E-Commerce-Gesetz (ECG) and Art. 6 of Regulation (EU) 2022/2065 on digital services.
(3) WoSuch is neither an estate agent nor a property developer and does not act as an intermediary in any way. Using the platform does not give rise to a brokerage contract within the meaning of the MaklerG, neither with WoSuch nor through the intermediation of WoSuch.
(4) WoSuch is not a party to the contracts concluded between users and providers and receives no commission or other transaction-related remuneration from them. Contact and all contractual discussions take place directly between the user and the provider, outside the platform.
(1) Guest access, free of charge and without registration: search, listing details, map view.
(2) Registered access, also free of charge: in addition, the watchlist, search agents with notifications, the history of one's own inquiries, the AI assistant and access to properties with a purchase price of two million euros or more.
(3) There are no paid services for users searching for property. All functions are available free of charge.
(4) There is no entitlement to registration. WoSuch may refuse a registration or block an account if these GTC have been breached; § 8 Abs. 3 remains unaffected.
(1) A valid email address is required for registration. Further details — first and last name, phone number — are optional and serve solely to fill in the contact form to a provider more quickly.
(2) The user is responsible for keeping their access data confidential and must inform WoSuch if they have any indication of unauthorized use of their account.
(3) An account is not transferable.
(4) The data processed during use are described in the Privacy Policy; it is part of the information provided, not of these contractual terms.
(1) Search and display. The results shown are based on the data entered by providers and on an algorithmic matching to the search criteria. Unless the user chooses a different sort order, results are ordered by the completeness and the recency of the listings; among listings of equal standing the order changes several times a day. The main parameters of the order are described on the "How we sort" page, which can be reached from the search results and from the website footer. No completeness or up-to-dateness of the results is promised.
(1a) Paid placements and advertising. Providers can book a top placement for a listing against payment. Such a listing appears only if it matches the search criteria, only in the standard order and at fixed positions of its package, but never further down than without booking. The "Featured properties" row on the homepage consists of advertising. Listings that stand further ahead because of a top placement, and advertising, are always marked "Ad". WoSuch offers no other paid means of influencing the order.
(2) AI assistant. Search requests in your own words are translated into search criteria with the help of a language model from Anthropic PBC. The assistant requires an account and separate consent to the transfer to Anthropic. It is a search aid: its outputs may be incomplete or inaccurate and do not constitute advice. The number of requests is limited to twenty per day and account.
(3) Map view. The interactive map is provided via Mapbox Inc. and requires separate consent to the associated transfer. Without this consent, search and listing details remain available; a list takes the place of the map. The street-level view of a listing is provided by Google and is loaded only upon your action. The images may be several years old; WoSuch gives no warranty as to their content, currency or availability.
(4) Search agents. Newly published and updated listings are checked against saved criteria. A notification is sent if the user has enabled it. There is no entitlement to complete or immediate notification; the check is automated and may fail to take place due to technical faults.
(5) Watchlist and inquiry history. Saved listings and one's own contacts can be viewed in the account. The watchlist does not replace a reservation: a saved listing may be changed or withdrawn by the provider at any time.
(1) All listing details — descriptions, prices, floor areas, photos, floor plans, energy performance certificates, contact details and availability hours — are published and maintained by the providers themselves. WoSuch has no influence on this content and gives no warranty as to its accuracy, completeness, currency or lawfulness.
(2) In particular, WoSuch gives no warranty that a property is still available, that the stated price is correct or that the provider is entitled to market the property.
(3) Responsibility for third-party content arises only once a specific infringement is known and not removed (§ 16 ECG). Please report unlawful content to support@wosuch.com. Every report is reviewed; the reporting person is informed of the outcome. Unlawful content is removed or blocked without undue delay once it comes to our knowledge.
(4) The information displayed on the platform does not constitute legal, tax, financial or investment advice.
(1) The design, structure, software and the texts and graphics created by WoSuch itself are protected by copyright.
(2) Content published by providers remains the property of the respective provider. By publishing it, the provider grants WoSuch a simple right of use for display on the platform.
(3) The user may access and save content of the platform for their own, non-commercial use. Any further reproduction, distribution or making available to the public requires the consent of the respective rights holder.
(1) Use is permitted for personal, non-commercial purposes.
(2) The following are prohibited in particular: • automated requests, the systematic extraction of content (scraping) and the circumvention of access or security mechanisms; • entering false or misleading information; • harassing providers or other users; • attempts to induce the assistant's language model to produce outputs that do not serve the property search.
(3) In the event of a breach, WoSuch may block access temporarily or permanently. Before a permanent block, the user is given the opportunity to respond, unless this is unreasonable due to the severity of the breach. An objection to a block can be raised at kontakt@wosuch.com.
(1) WoSuch is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
(2) In the case of slight negligence, WoSuch is liable only for the breach of essential contractual obligations — that is, obligations whose fulfilment makes the proper use of the platform possible in the first place and on whose observance the user may rely — and only up to the amount of the typical, foreseeable damage.
(3) WoSuch is not liable for the contracts concluded between users and providers or for their performance.
(4) The mandatory provisions of the Konsumentenschutzgesetz (KSchG) and the Produkthaftungsgesetz remain unaffected. The statutory limitation periods apply to claims.
(1) Uninterrupted availability of the platform is technically impossible and is not owed.
(2) Maintenance work is announced in advance where possible.
(3) WoSuch may change or discontinue individual functions. If a function that is essential for use is discontinued, this will be announced with reasonable notice.
(1) The user relationship is for an indefinite period and can be ended by the user at any time without giving reasons by deleting their account: in the app under Profile → Delete Account.
(2) Deletion removes the account, the profile details, the watchlist, the recently viewed listings, the inquiry history, the search agents and the AI assistant conversation histories. Which data are retained beyond this for legal reasons is described in the Privacy Policy.
(3) WoSuch may terminate the user relationship with four weeks' notice. In the event of a serious breach of these GTC, termination with immediate effect is possible; § 8 Abs. 3 applies accordingly.
(1) WoSuch may change these GTC if this is necessary due to a change in the law, in case law or in the scope of services.
(2) Users are informed of a change in the app and on the website no later than thirty days before it takes effect.
(3) If the content changes materially, consent is obtained again. In this case, mere continued use does not count as consent. Anyone who does not consent can continue to use the platform without an account or delete their account.
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers: mandatory protective provisions of the country in which they have their habitual residence remain unaffected. The place of jurisdiction is determined by § 14 KSchG; a consumer can only be sued at their place of residence, habitual residence or place of employment.
(3) For businesses, the place of jurisdiction is Vienna, Innere Stadt.
WoSuch is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body.
(1) Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory rule.
(2) The German version of these GTC is binding. Translations are provided for information only.
