GENERAL TERMS AND CONDITIONS (GTC) for the use of the WoSuch Platform Last updated: September 2026 Note: The German version of these GTC is authoritative. This English version is provided for information purposes only. § 1 Scope and Subject Matter (1) These General Terms and Conditions (GTC) govern the use of the digital real estate information platform WoSuch (wosuch.com and mobile apps for iOS and Android), operated by Mykola Gnylytskyy, Gentzgasse 21, 1180 Vienna, hereinafter "WoSuch". (2) WoSuch operates a pure information platform (hosting provider within the meaning of § 16 ECG). The service consists of the technical aggregation and display of real estate information between commercial providers (agents and developers) and prospective buyers/tenants. The platform does not constitute a brokerage service within the meaning of the Austrian Real Estate Agents Act (MaklerG). (3) Disclaimer regarding brokerage: WoSuch is neither a real estate agent nor a property developer and does not participate in any rental or purchase agreements between users and providers. WoSuch receives no commission or transaction-related remuneration. (4) These GTC apply exclusively to B2C users. Separate B2B terms apply to agents and developers. § 2 Types of Use (1) Guest access (free): Basic search functions (including AI assistant and map view) are available free of charge without registration. (2) Registered user (free): Free registration (e-mail address) provides access to extended functions: watchlist (favourites), search agents with push notifications, enquiry history, and premium listings (properties from €2 million). (3) There are currently no paid tiers for B2C users. All app features are available to registered users free of charge. (4) No right of access: WoSuch reserves the right to refuse registrations without stating reasons or to suspend accounts in the event of violations of these GTC. § 3 Service Description (1) AI-assisted search: Text search queries are interpreted using AI technology (Anthropic) and matched against listing data. AI search requires your consent to data transfer to Anthropic (USA). (2) Map view (Mapbox): Display of listings on an interactive map requires your consent to data transfer to Mapbox (USA). (3) No warranty for result quality: Results are based on algorithmic matching against third-party data. WoSuch provides no warranty for the availability, accuracy, or completeness of search results. AI interpretations may contain errors. (4) Availability: Uninterrupted availability of the platform is technically not possible and is not warranted. Maintenance work will be announced where possible. (5) Data source: All property data (descriptions, prices, photos, contact details) is provided exclusively by B2B partners (agents and developers), who are solely responsible for its entry and updating. § 4 Limitation of Liability (1) Third-party content: WoSuch is not liable for content uploaded by B2B providers (property descriptions, prices, photos, contact details etc.). This content reflects solely the information provided by the respective provider. WoSuch provides no warranty for the accuracy of prices, property attributes, availability, or the identity of providers. Any legal infringements by third-party content will be removed promptly upon becoming known. (2) Own services: WoSuch is liable for damages arising from the breach of material contractual obligations; in cases of minor negligence, liability is limited to typically foreseeable damage. WoSuch is fully liable for gross negligence and intentional misconduct. (3) Free use: For free use of the platform, WoSuch is liable only for intentional misconduct and gross negligence, not for minor negligence. (4) No consequential damages: WoSuch is not liable for lost profits, indirect or consequential damages, to the extent permitted by law. (5) Limitation period: Claims against WoSuch are time-barred, to the extent permitted by law, 12 months after the claimant became aware of the damage. (6) Not professional advice: Information on the platform does not constitute legal, financial, or investment advice. Professional advice is strongly recommended before making any real estate decisions. § 5 User Obligations (1) Use is permitted for personal, non-commercial purposes only. (2) Prohibited: automated queries and scraping, manipulation of AI systems, entry of false data, harassment of providers or other users, circumvention of security mechanisms. (3) Violations may result in temporary or permanent suspension. § 6 Data Protection and Consents (1) The Privacy Policy (available in the app and at wosuch.com/at/datenschutz) is an integral part of these GTC. (2) Use of the AI assistant and map view requires separate consents for third-country transfers (Anthropic/Mapbox, USA). § 7 Termination and Account Deletion (1) Users may delete their account at any time in the app (Profile → Delete Account), triggering full cascade deletion of all personal data. (2) WoSuch may suspend accounts with immediate effect in cases of serious GTC violations. § 8 Final Provisions (1) Governing law: Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of the user's country of residence apply. (2) Jurisdiction: For businesses: Vienna (1st district). For consumers: statutory jurisdiction (§ 14 KSchG). (3) Severability: Invalid or unenforceable provisions do not affect the validity of the remaining GTC. (4) Amendments: WoSuch reserves the right to amend these GTC with 30 days' notice, displayed in the app. Users who do not accept changes are entitled to delete their account. (5) Language: The German version of these GTC is authoritative.
